Family law is a sensitive area of law. Do you need professional advice when drawing up a marriage contract or, in the event of a divorce, when negotiating a divorce settlement agreement? Even if many things have already been settled in advance, many questions arise at the end of a relationship with regard to the arrangement of separate lives: What happens to the shared home and other assets? How will child rearing be arranged? What about maintenance payments, whether for children and/or the spouse? Who pays for what? The divorce is pronounced by order of the family court. As the divorce petition can only be filed by a lawyer, at least the spouse who wishes to file for divorce needs a lawyer. During the separation phase, however, the spouses can decide how they want to deal with the consequences of the separation and divorce. Most marriages are divorced by mutual consent. In contrast to a contested divorce, in an amicable divorce the spouses agree on a workable solution for both parties in an out-of-court agreement on the consequences of the divorce. These are often issues with a high potential for conflict, such as Equalization of accrued gains, parental custody and rights of access to joint minor children as well as maintenance and pension equalization.

The parents are jointly entitled to parental custody of matters that are of considerable importance for the minor child (e.g. moving to another place of residence, changing schools, operations, religion, etc.). This does not change even after the divorce, as long as neither parent applies for sole custody or if a custody arrangement is necessary due to a risk to the child’s welfare. The child has a right to contact with the parent with whom it does not live.

Separation and divorce are immediately followed by existentially significant questions of maintenance law. The basis of a shared lifestyle is taken away. Therefore, the economically weaker spouse is generally entitled to maintenance. Whether and to what extent a claim for maintenance exists is determined primarily by the neediness of the applicant and the ability of the party obliged to pay maintenance. The parent who has custody of the minor child can also claim child maintenance from the other spouse in their own name.

Pension equalization determines the equalization of pension entitlements between spouses after divorce. Pension entitlements are generally divided equally.
